Michigan School District Files Lawsuit, Forms Coalition to Block EFM (ContributorNetwork)

Highland Park (Mich.) School District, which was placed under the auspices of an emergency financial manager on Monday, announced the formation of a coalition designed to oppose state control and decide upon alternative measures, according to Michigan Radio.

The coalition, which is made up of school board officials and other local leaders, has vowed to fight newly appointed EFM Jack Martin. A lawsuit challenging the state's right to appoint an EFM was filed by School Board Secretary Robert Davis on Monday, according to the Detroit Free Press.

Here is information surrounding the district.

* Davis' lawsuit alleges the meetings regarding the beleaguered school district's financial situation violated the state's open public meetings law by being held behind closed doors. He named Gov. Rick Snyder, state Superintendent Michael Flanagan and members of the state-appointed financial review team as defendants.

* Davis is seeking a temporary restraining order to prevent Martin from beginning his duties.

* State Senator Bert Johnson, D-Highland Park, announced the formation of the Financial and Academic Reinvestment Commission, according to the Detroit News.

* The commission is reportedly going to join forces with other groups in the state that have formed in opposition to Public Act 4. It is also focused on spurring reinvestment and encouraging repopulation in the district, according to the Huffington Post.

* Rev. D. Alexander Bullock, a member of the new commission, has said EFMs have caused "irreparable damage" to Detroit Public Schools and the cities where EFMs have been placed in charge of managing budgets and deficits.

* Highland Park Superintendent Edith Hightower announced the district would close one of its three remaining schools after the consolidation of its two K-8 schools is complete. She also announced the district's administrative offices would change locations to one of the two open schools, according to MLive.

* Barber Focus School will close and all students will be moved to Henry Ford Academy.

* Hightower said the decision to close the school had been made before Gov. Snyder declared Highland Park to be facing a financial emergency and before he appointed Martin to be the district's EFM.

Comcast Establishes Legal Regulatory Group - Influence Alley

One year after the Federal Communications Commission approved its merger with NBCUniversal, Comcast is starting a legal regulatory group to make sure the conditions of the agreement are met and to offer legal advice that accounts for the business interests of both Comcast Cable and NBCUniversal.?The group will be led by Lynn Charytan, Comcast's vice president of legal regulatory affairs. She joined Comcast in 2010 after working as chair of the communications, privacy and Internet law practice group at WilmerHale.

Five dead at bullet-riddled home in Birmingham (Reuters)

BIRMINGHAM, Ala (Reuters) ? The bodies of five people shot dead were found early on Sunday morning at a house riddled with bullet holes west of downtown Birmingham, the Birmingham Police Department said.

Officer Buddy Parsons said the victims found at the home in the Ensley Highlands area were all shot dead.

"The police told us there had been murders," said Beatrice Houston, who lives across the street from the neat white house with green trim where the bodies were found.

"They said five men were dead and that two people got away," she said.

Her husband, Willie Houston, said he saw five bodies taken out of the house and placed in coroner vans.

The quiet working class neighborhood of cottages about 5 miles from downtown was lit up by flashing police cruisers that swarmed the street before dawn.

"I'm used to seeing stuff like this on TV, not in my own neighborhood," Beatrice Houston said.

Police were interviewing possible witnesses, Sergeant Vincent Green told Reuters.

Birmingham Police Sergeant Johnny William appealed for anyone with information on the case to contact police.

Researchers discover cancer in Egyptian mummy

? A professor from American University in Cairo said the discovery of prostate cancer in a 2,200-year-old mummy indicates the disease was caused by genetics, not environment.

AUC professor Salima Ikram, a member of the team that studied the mummy in Portugal for two years, said Sunday the mummy was a man who died in his forties.

She said this was the second oldest known case of prostate cancer.

?Living conditions in ancient times were very different; there were no pollutants or modified foods, which leads us to believe that the disease is not necessarily only linked to industrial factors,? she said.

A statement from AUC said the oldest known case came from a 2,700-year-old skeleton of a king in Russia.

    The Newt I know (Politico)

    Yeah, yeah. I know. Newt Gingrich had a lousy week and will probably lose the Florida primary on Tuesday. But for those tempted to once again predict the speedy collapse of his campaign, consider yourselves forewarned. I?ve known this guy long enough to realize that the only three species destined to survive a nuclear holocaust will be cockroaches, Cher and Newton Leroy Gingrich.

    I first met Gingrich 17 years ago at a Destin, Fla., fundraiser held in my honor a few weeks after Newt declared that I was too conservative to win the general election. But after I won the primary against the moderate woman he anointed, there he was in Florida looking supremely bored and a little put out that he was having to sit through another politician?s speech.

    In the ensuing years, I found the mercurial maverick to be inspiring and maddening, disciplined and self-indulgent, forward thinking and short-sighted, gifted and dumb ? sometimes all within the same hour.

    If, as Shakespeare wrote, what?s past is prologue ? and it often is ? then Gingrich?s political history is particularly relevant now. It?s a history I know well because I was there. And what I saw at the revolution has concerned me since I left Washington.

    Many who have heard my harsh assessments of Gingrich over the past year have assumed that I feel a personal animus toward my former colleague. That?s just not true. That fact is that I remain awestruck that Newt envisioned a Republican majority when his closest allies thought he was crazy. Even an eternal optimist like me laughed at the ?Think Majority? sign hanging over the NRCC reception area in early 1994.

    But Newt was right and we were wrong. The Gingrich Revolution overtook Washington (with a huge assist from Bill Clinton?s overreaching agenda) and good things followed. Within a few years, Congress passed the first balanced budget in a generation, welfare reform, tax cuts and meaningful congressional changes.

    If Newt?s story ended there, I might have a Gingrich 2012 sign in my front yard. But unfortunately, it does not.

    Three years into his speakership, the man who helped draft the Contract With America began trying to undo some of that document?s key provisions. The government shutdown had badly damaged the speaker?s brand and he went to work trying to raise his 27 percent approval rating.

    In April 1997, Gingrich told The New York Times he was ready to be a kinder and gentler Republican by negotiating away the very tax cuts that he had once called ?the crown jewels of the contract.? Soon, conservatives were being pressured to vote for big spending appropriations bills. In his final speech from the floor of Congress, Newt Gingrich lashed out wildly at the same freshmen who had made him speaker ? mocking us as cannibals who made up ?the perfectionist caucus.?

    Denver appeals court upholds military impostor law (AP)

    DENVER ? The 10th U.S. Circuit Court of Appeals ruled Friday that a federal law making it illegal to lie about being a war hero is constitutional and making false statements is not always protected free speech.

    The ruling by a three-judge panel of the Denver-based court reverses a district judge's decision that the Stolen Valor Act violates the First Amendment.

    Courts in California, Georgia and Missouri have considered similar cases, and the 9th U.S. Circuit Court in San Francisco struck down the law on the basis of free speech. The U.S. Supreme Court said in October it would take up the issue of whether the Stolen Valor Act is constitutional.

    The Colorado case involves Rick Strandlof, who was arrested after claiming he was wounded in Iraq as a Marine and had received military medals. His lawyers have acknowledged the claims were false.

    "As the Supreme Court has observed time and again, false statements of fact do not enjoy constitutional protection, except to the extent necessary to protect more valuable speech," Judges Timothy M. Tymkovich and Bobby R. Baldock said in the ruling. "Under this principle, the Stolen Valor Act does not impinge on or chill protected speech, and therefore does not offend the First Amendment."

    Judge Jerome A. Holmes, who dissented, said, "I am troubled by the majority's conclusion that false statements of fact ? even those that are knowingly made, with an intent to deceive ? are categorically outside the protective walls of the First Amendment."

    It wasn't immediately known whether Strandlof would appeal. A phone message seeking comment was left for his lawyer, John T. Carlson, on Friday.

    Congress passed the Stolen Valor Act in 2006 with overwhelming support. It has been used only a few dozen times.

    In arguments before the 10th Circuit last year, Justice Department lawyer Joe Palmer said the law is constitutional because the government has a compelling need to punish impostors to protect the integrity of military medals. Carlson argued that the fact a statement might be offensive doesn't mean it isn't protected by the First Amendment.

    Strandlof founded a veterans group in Colorado Springs and said he had received the Purple Heart and Silver Star. His claims were questioned, and the military said it had no record that he ever served. He was charged in 2009 with violating the law, but a federal judge dismissed the case, saying the U.S. government had not shown any compelling reason to restrict that particular type of speech.

    The California case, which U.S. Supreme Court decided to review, centers on the government's prosecution of Xavier Alvarez of Pomona, Calif. Alvarez, a member of the local water district board, said at a public meeting in 2007 that he was a retired Marine who received the Medal of Honor, the nation's highest military decoration. He had never served in the military.

    Mexico ups swine flu screening as cases increase (AP)

    MEXICO CITY ? Mexico's health ministry is reporting an increase in swine flu cases this year and has instituted screenings in schools where children show symptoms.

    The health ministry says there is no cause for alarm, saying there is no epidemic like that three year ago.

    The ministry on Sunday reported 637 confirmed cases of all flu strains so far in 2012. It said there had been 10 deaths ? nine of them among the 573 confirmed cases of the H1N1 strain of swine flu.

    On Jan. 15, it reported just 181 cases and five deaths. It said there were 870 cases of all strains and 35 deaths in 2011.

    Mexico experienced a major outbreak of the H1N1 strain in the spring of 2009 that shut down much of the country and caused an international scare.

    Merle Haggard returns to California to recuperate

    NASHVILLE, Tennessee (AP) ? Country music legend Merle Haggard has returned home to northern California to recuperate from multiple illnesses.

    Haggard had been hospitalized in Macon, Georgia, for about a week with double pneumonia. While there, doctors discovered three stomach ulcers and eight polyps in his colon.

    At one point, the 74-year-old checked himself out of the hospital to try to return to Redding, California, by tour bus. But he returned a few hours later after deciding the trip would be too taxing.

    The "Okie from Muskogee" singer was diagnosed with lung cancer a few years ago, but recovered after part of his lung was removed.

    It's unclear how Haggard's recent health issues will affect his touring schedule. His website shows him playing next on Feb. 28 in Tucson, Arizona.

    What the filmmaker has created is an inspired simulacrum - a jewel-box that contains more of Bausch's kinetic soul than film has any right to.

    >> he's described as the head of public policy . we talked about what their positions ought to be and we talked about where they found themselves. let me point out. i think it's fascinating to watch everybody go by and dismiss it. the contract says "no lobbying," period. that was the question raised and the contract is clear. no lobbying, period. i offered strategic advice. i think that's the important thing to remember. i stand by that. also in the one written document at freddie mac said they needed more regular fwlagss. the one time i spoke to the house republicans about freddie mac the new york times reported in july of 2008 , i told them not to give freddie mac or fannie mae money. i said i was opposed to giving them taxpayer money. it's hard to explain why my offering strategic advice wasn't in the public interest when i said, don't give them the money.

    DuPont sees slight 4Q dip, record annual earnings (AP)

    DOVER, Del. ? The DuPont Co. said Tuesday that fourth-quarter income dipped slightly as volume declines and cost increases offset sales gains and higher prices.

    The company reported net income for the quarter of $373 million, or 40 cents per share, compared with $376 million, or 40 cents per share, in the previous year's fourth quarter. DuPont attributed the results to broad-based volume declines, a higher tax rate, and higher costs for raw materials, which offset higher selling prices in all regions and a 14 percent increase in revenue.

    Excluding one-time items, earnings per share were 35 cents, down from 50 cents per share in the corresponding quarter of 2010. That topped analysts' expectations for earnings of 33 cents per share, according to FactSet.

    For the full year, DuPont said higher selling prices and acquisitions in health and nutrition and industrial biosciences helped lead to record earnings. The Wilmington, Del.-based science company reported full-year earnings of about $3.5 billion, or $3.68 per share, compared with $3.05 billion, or $3.28 per share, for the previous year.

    Last month, DuPont cut its 2011 earnings forecast due to weaker demand in several sectors, including electronics and industrial supplies, predicting an adjusted 2011 profit of $3.87 to $3.95 per share, down 10 cents from its October guidance and below what analysts had expected.

    DuPont reaffirmed its previous guidance for earnings to increase by 12 percent this year, to a range of between $4.20 and $4.40 per share.

    "We delivered exceptional full-year results in 2011 despite significant market headwinds late in the year," said DuPont chairwoman and CEO Ellen Kullman. "... We remain well-positioned to serve customers and innovate as key markets rebound and global population growth drives new opportunities."

    In the fourth quarter, however, DuPont saw volumes decline in all regions, led by a 23 percent drop in the Asia-Pacific region. The company said the volume declines were driven by destocking in photovoltaics, polymer and industrial supply chains, and weaker demand for products used in consumer electronics and construction.

    In DuPont's electronics and communications unit, revenue fell 18 percent, and volumes declined by 33 percent. Volumes were down 17 percent in performance chemicals and 13 percent in performance materials.

    DuPont said sales in its nutrition and health unit were up $468 million to $806 million, reflecting last year's acquisition of Danish company Danisco's specialty food ingredients business.

    The agriculture unit led all DuPont business segments in full-year volume performance with an increase of 10 percent. Double-digit sales growth in many other units was largely attributable to higher selling prices.

    Chipmaker AMD expects lower revenue in weak PC market (Reuters)

    (Reuters) ? Advanced Micro Devices Inc forecast lower quarterly revenue as a shortage of hard drives and a shaky economy hurt PC makers, sending its shares lower in after-hours trading.

    The PC chipmaker's fourth-quarter adjusted earnings beat expectations, but revenue for the quarter just ended and revenue projections for the current quarter came in a bit below many analysts' expectations.

    Like larger rival Intel Corp, AMD has been wrestling with slow demand for chips as consumers increasingly buy Apple Inc's iPad instead of laptops.

    Also hurting sales of processors, PC manufacturers have been struggling to obtain enough hard drives to meet production targets after flooding last year ruined factories and sensitive machinery in Thailand, the world's No. 2 exporter of the components.

    Intel beat scaled-back quarterly earnings expectations last week after warning that the hard drive shortage was hurting PC production. It also warned of lower revenue in the current quarter.

    AMD depends more on sales of PC processors for its revenue than does Intel, which sells proportionally more chips for servers. It grew its PC chip revenue 2 percent sequentially in the fourth quarter, while Intel's PC chip business dipped slightly during the same period.

    "They did slightly better than Intel in Q4 in their PC business but they have to show that consistently over a few quarters for investors to give them credit," said CLSA analyst Srini Pajjuri.

    Chief Executive Rory Reid said AMD has corrected a problem with the production of its 45 nanometer chips that hurt output in recent quarters and expects a rebound in production in the current quarter.

    Also on Tuesday, programmable chipmaker Altera posted quarterly results above analysts' estimates but its weak first-quarter outlook sent shares down 3 percent after the bell.

    With PC sales suffering, AMD and Intel have failed to find a foothold in smartphones and tablets, where processors based on ARM Holdings' power-efficient chip designs are widely used.

    Apple became the largest buyer of semiconductors last year, overtaking Samsung Electronics and Hewlett-Packard Co as sales of iPads and iPhones outpaced PCs and other consumer gadgets, according to market research firm Gartner.

    Dogged by concerns the PC chipmaker is being left behind in the fast-growing mobile market, shares of AMD have fallen about 13 percent over the past year.

    AMD said revenue in the fourth quarter rose 2 percent from the year-ago period, to $1.69 billion.

    But it said revenue in the quarter ending in March would fall 8 percent from the previous quarter, plus or minus 3 percentage points, to around $1.504 billion to $1.606 billion.

    Analysts on average expected fourth-quarter revenue of $1.716 billion and March-quarter revenue of $1.595 billion, according to Thomson Reuters I/B/E/S.

    Non-GAAP earnings in the quarter were $138 million, compared with $106 million in the year-ago period. Non-GAAP earnings per share were 19 cents, compared with 14 cents in the year-ago quarter. Analysts on average expected earnings per share of 16 cents.

    AMD shares were down 2.7 percent at $6.35 in extended trading after closing up 0.15 percent at $6.53.

    802.11ac, sometimes referred to as 5G or gigabit Wi-Fi, hasn't been finalized and Apple seldom if ever speaks ahead of time about the incorporation of new technology into the iPhone, iPad, or Mac lines, but they were aggressive in adopting 802.11n while it was in the draft stages and 802.11ac appears to have even more to recommend it.

    SANAA, Yemen (AP) ? Outgoing Yemeni President Ali Abdullah Saleh is getting ready to leave the country after delivering a farewell speech on Sunday, apologizing for mistakes and saying it is time to hand over power, Yemeni officials said.

    Aides to the president told The Associated Press that Saleh gathered top political, military and security officials and announced promotion of Yemeni Vice President Abed Rabbo Mansour Hadi to the rank of marshal. He is set to replace Saleh.

    "I appeal to you to forgive my past mistakes," one top ruling party official quoted Saleh as saying. "Today, I leave the country in your hands," he said, according to the official, who was among those attended the event early in the morning. In November Saleh signed a power transfer deal but has balked at actually leaving.

    Another aide who attended the meeting quoted Saleh as saying, "I am leaving this good country, today. I want to bid you farewell from this place. I thank each one of you and offer my apology to the people and ask for forgiveness."

    A third official said that Saleh declined to hold a departure ceremony and preferred to offer his farewell behind closed doors.

    The officials requested of anonymity because they were not authorized to speak to reporters.

    On Saturday, Yemeni officials said that Saleh intends to leave soon to Oman, en route to medical treatment in the United States, part of an American effort to get the embattled strongman out of the country to allow a peaceful transition from his rule.

    Washington has been trying for weeks to find a country where Saleh can live in exile, since it does not want him to settle permanently in the United States. The mercurial president, who has ruled for more than 33 years, has repeatedly vacillated over whether he would leave.

    After nearly a year of protests demanding his ouster, Saleh signed the agreement to hand his powers over to Hadi and step down. Hadi set up a unity government between his party and the opposition.

    Even so, Saleh ? still formally the president ? has continued to influence politics from behind the scenes through his family and loyalists in positions of power.

    Longtime Hamas leader Mashaal asks to quit (AP)

    GAZA CITY, Gaza Strip ? Hamas chief Khaled Mashaal has decided not to seek another term, the movement said Saturday, paving the way for a possible leadership contest at a time when the anti-Israeli Islamic group faces far-reaching decisions on whether to stay the course of militancy or moderate.

    However, Hamas suggested Mashaal could be asked to stay on, in what would be a boost for his more pragmatic line.

    Mashaal could not be reached for comment Saturday, but his decision not to seek another term as head of Hamas' political bureau was confirmed in a Hamas statement. Mashaal, who like other top Hamas leaders is based in Syria, has led the 15-member bureau since 1996, or nearly twice as long as permitted under Hamas rules.

    Hamas said Saturday the final decision on Mashaal's future will be left to the 55-member Shura Council, which oversees the political bureau and authorizes key decisions. Mashaal was last reaffirmed in his post in April 2009, and it is not clear if and when the Shura Council would appoint a successor.

    Word of Mashaal's decision comes at a time of change in Hamas' relationship with its parent movement, the pan-Arab Muslim Brotherhood. The Brotherhood has scored election victories in Egypt and Tunisia following the pro-democracy protests of the Arab Spring over the past year, and has urged Hamas to moderate.

    Brotherhood leaders have encouraged Mashaal to pursue reconciliation with Palestinian rival Fatah, led by Western-backed Palestinian President Mahmoud Abbas, and to abandon violence, according to several Hamas figures.

    In discussions within Hamas, Mashaal has praised the pragmatism of the Brotherhood and proposed that Hamas take steps toward becoming a strictly political movement, rather than also maintaining a parallel military wing. This would eventually require a decision to halt attacks on Israel, something Hamas has so far avoided.

    In recent months, Mashaal has led attempts to reconcile with Fatah, although he has encountered some opposition from senior Hamas activists in the Gaza Strip, controlled by the Islamists since they seized the territory from Abbas in 2007. The Gaza branch of Hamas would likely lose jobs and influence in any reconciliation deal.

    Mashaal is to meet with Abbas in Cairo early next month to try to move bumpy reconciliation efforts forward. The rivals had previously agreed to hold general elections in the Palestinian territories in late spring, but smaller gestures, such as mutual prisoner releases, have not yet been carried out, suggesting continued distrust.

    Some in Fatah expressed concern Saturday that a Hamas leadership change could put reconciliation on hold.

    "Mashaal had a significant role in pursuing reconciliation," said Amin Maqboul, a Fatah negotiator in the talks with Hamas. "We hope that his successor takes the same path, particularly ... since there are some forces in Hamas in Gaza who are not interested in reconciliation."

    Raed Naerat, a West Bank-based Hamas expert, said he expects the movement to stay on Mashaal's current course, arguing that his policies have been endorsed by the collective leadership.

    Mashaal first told the Hamas leadership at a Shura Council meeting in Sudan last month that he does not plan to seek re-election, according to Hamas insiders who spoke on anonymity because of the sensitivity of the issue.

    It is unclear whether Mashaal is serious about stepping aside, or hopes to elicit a show of support from the movement by announcing he is not seeking re-election. Under Hamas' internal rules, the head of the political bureau can only serve two terms for a total of eight years, and Mashaal faced severe criticism in the past for staying on past that.

    Some said the Arab Spring may be influencing Mashaal's strategy.

    "With this step, Mashaal wanted to emphasize that Hamas is a democratic movement, but the final decision will be made by the Shura Council," said Ahmed Yousef, a Hamas figure in Gaza who spoke to Mashaal earlier in the week.

    It's not clear if and when Hamas elections would be held. Osama Hamdan, a senior Hamas official in Lebanon, said the date of possible internal elections would not be revealed, citing security reasons.

    Possible contenders for Hamas' leadership include Mashaal's deputy, Moussa Abu Marzouk, and Ismail Haniyeh, the Hamas prime minister in Gaza.

    In recent months, Mashaal has increasingly adopted a pragmatic tone, though Hamas insists it will not formally renounce violence or recognize Israel ? conditions set by the international community for ending its boycott of the group. In its founding charter, the movement is committed to Israel's destruction and has killed hundreds of Israelis in militant attacks that have included shootings and suicide bombings. Since 2007, the group has ruled the Gaza Strip, a sliver of territory wedged between Egypt's Sinai desert and Israel.

    In a December interview with The Associated Press, Mashaal said he wanted to focus on a strategy of holding mass protests against Israel, in the style of Egypt and Tunisia, where citizens successfully overthrew their dictatorships. However, he did not renounce violence.

    Hamas leaders in Gaza tend to adopt a harder line, although they have mostly observed a truce with Israel for the past three years. Palestinian militants from other groups have fired rockets at Israel with varying intensity recently, but it has not escalated into larger violence.

    Hamas considers all of Israel to be occupied Palestinian land. The Palestinian Authority, led by Abbas, seeks a state alongside Israel in the West Bank, Gaza and east Jerusalem.

    Mashaal is originally from the West Bank Palestinian village of Silwad. He survived an Israeli assassination attempt in 1997 in Jordan.

    Pepe told Real Madrid's website Thursday that "as far as the play with Leo Messi, I want to say that it was an involuntary act."

    The Portuguese defender added that "even so, if Messi is offended I ask his forgiveness because I want to defend my team and club. ... It never passed through my head to cause harm to a fellow professional."

    Pepe received a yellow card in the 17th minute of Madrid's 2-1 loss during Wednesday's first leg when he barged into Sergio Busquets, but referee Muniz Fernandez did not penalize him for stomping on Messi's hand when the forward was on the ground in the 68th minute.

    Pepe also fell to the field in the 65th minute clutching his face after coming into contact with Cesc Fabregas, but replays showed the Barcelona midfielder made contact with his arm and chest.

    Pepe's actions, as well as Madrid's defensive tactics, have been widely criticized in the Spanish media, including the Madrid-friendly sports dailies.

    Madrid coach Jose Mourinho said in the post-match news conference that he hadn't seen the incident, but that it would be "punishable" if it was done on purpose.

    The 28-year-old center back has collected eight yellow cards in 11 "clasico" matches and a red card in last season's Champions League semifinal with Barcelona. Pepe was suspended for 10 games in April 2009 after lashing out at two Getafe players in a skirmish that included him stamping on the back of Javier Casquero after pushing the player to the ground, unprovoked.

    The second leg of the total-goals quarterfinal will be played at Barcelona's Camp Nou stadium next week.

    Barcelona has beaten Madrid 10 times in their last 13 meetings. This was its sixth win against Madrid since Mourinho arrived in 2010.

    AT&T to adjust data plans January 22nd, offers more gigs for more money

    Good news and bad news here, folks: the good news is that AT&T will begin offering new data plans with a higher monthly allotment. The bad news is that, once again, it's going to cost you more. The plans, which will offer 300MB of data for $20, 3GB for $30 and 5GB (including mobile hotspot access) for $50, will take effect beginning this Sunday. Are you still on one of the older plans? Fortunately, you're still grandfathered in and won't have to change unless you absolutely want to. But remember that once you move to the new data rate, there's no going back; the only legacy plan sticking around is AT&T's 250MB tablet feature for $15. The change in plans appears to be priced the same as Verizon, though the two higher rate plans on AT&T have an advantage in that it hooks you up with an extra gigabyte of data capacity. The question is, will it be worth paying an additional $5 per month for that extra gig? Oh, and we're still waiting on that shared data plan in the meantime, Ralph.

    Intel: Better Android Performance on Medfield Processors

    Intel will shake up the smartphone market if its Medfield processor is as powerful as the company has claimed it to be.?

    According to EE Times, Mike Bell, Intel's Vice President of Ultra Mobility made a bold statement during an interview that the company has the hardware to make Android "really shine". Bell remarked that with the 32-nm system-on-a-chip (SoC) making huge improvements in power efficiency, the Medfield chipset is as power efficient as its competitors.?

    EE Times - "We have chips that are just as power efficient as everyone else. At the same time, they?re faster,? he said adding that from a performance standpoint, Intel was really pushing the envelope.

    Bell added that the partnership with Google makes Intel "a first class citizen" in the Android ecosystem. This means that Intel is able to release optimized processors simultaneously with each new iteration of Android. He believes that it is ultimately the user experience that will help Intel differentiate itself from the competition.?

    However, ?ARM CEO was not impressed with Intel's efforts and regarded them as not truly competitive as its ARM designs. With Intel expected to release Android-powered smartphones and tablets in the first half of 2012, it will be interesting to see how the competition play out in the near future.?

    Ventre: Will mighty Ravens defense crumble vs. Patriots?

    Ray Lewis & Co. beat up on lesser teams all season, but not against elite foes

    The Baltimore Ravens did nothing this year to tarnish their reputation as the sneering bullies of the NFL. They finished the regular season ranked third in total defense, allowing a total of just over 288 yards per game. They were also third in scoring defense, giving up 16.6 points per contest.

    They can still hold their fearsome heads high while they smack passersby out of the way and seize the best tables at restaurants through intimidation. Their place as denizens of defensive destruction is secure.

    Yet they might want to hold off just a tad on uninhibited sack dancing and muscle flexing until they vanquish a real offense. And one of those is on tap for Sunday.

    The New England Patriots, with valiant Tom Brady at the quarterback position, represent the greatest challenge of the season for the Ravens? defense. The Pats were No. 2 in the NFL in total offense, averaging 509 yards per contest. They also were No. 3 in scoring, at 32 points per game. And last weekend Brady & Co. chopped up the Broncos? defense like a Benihana chef, resulting in a 45-10 New England victory.

    Sure, the Ravens are tough. Of course, they?re frightening. Indeed, they?re difficult to beat.

    But take a look at their schedule for 2011. Examine the opponents they left in their wake. It?s as if they beat the snot out of the chess club.

    They did defeat the Pittsburgh Steelers twice, I?ll give them that. Those were two fine victories. The first, a 35-7 win at home in the season opener, was killer, but it seemed somewhat fluky given the rabid nature of this brutal rivalry. It was as if the Steelers all got the same late wake-up call at the hotel. The second was a 23-20 victory in Pittsburgh that was far more impressive if you?re a Ravens honk. Yet even in that one Baltimore gave up almost 400 total yards.

    The rest of the Ravens? slate is the issue. Ruffians though they may be, they only got to face one other ?elite? quarterback. That was Philip Rivers on Dec. 18. I think we?re all aware that early in 2011 the real Philip Rivers was kidnapped and replaced with a defective avatar -- he threw for 27 TDs but also 20 picks and seven lost fumbles this year -- and yet he still solved the Ravens? defense in a 34-14 trouncing.

    Aside from the two meetings with Roethlisberger, it was the one other time the Ravens faced a so-called elite quarterback -- and he dropped 34 on them, the most points the Baltimore D allowed all year.

    Take a gander at the other arms the Ravens had to face. Andy Dalton had a strong year for a rookie in Cincinnati, but he?s a rookie, and the Ravens barely beat him twice. They also halted Cleveland twice -- once with Colt McCoy at quarterback, the other time with Seneca Wallace.

    The Baltimore defense defeated the Jets with a struggling Mark Sanchez; the Colts without Peyton Manning; the Cardinals with a shaky Kevin Kolb; and the Rams with a defenseless Sam Bradford.

    They also beat the 49ers on Nov. 24, and while I?m generally impressed with the rejuvenation of Alex Smith, he's not elite yet.

    It should also be noted that the Ravens are playing in New England.

    The Ravens have four losses, and they all came on the road. Aside from Rivers in San Diego, the Ravens lost to Matt Hasselbeck in Tennessee; to rookie Blaine Gabbert in Jacksonville; and to Tarvaris Jackson in Seattle. To be fair, Hasselbeck is a quality signal-caller. And the Jaguars actually won their game by holding the Ravens to seven points while kicking four field goals; Gabbert?s major contribution consisted of remaining ambulatory.

    But the overall point still applies. These mean, rugged, no-nonsense defensive Goliaths from Baltimore haven?t faced anything like the passing attack of Tom Brady, and they?ll be doing it before a hostile crowd. If they can?t cope, the goose of the Ravens will be cooked, and so will their reputation as league?s preeminent muggers.?

    The Patriots certainly have defensive issues of their own. They managed to silence the din generated by the Tim Tebow faithful when they desecrated the Broncos last week.

    But Joe Flacco is at least a capable quarterback, and Ray Rice is a formidable rushing threat. Unlike their game against Denver, stopping the Ravens? offense will be a grown-up task for the Patriots, and it will reveal whether New England?s defense is rising to the occasion at the right time after a disappointing showing in 2011, or if it simply rose to one occasion against an inept offense.

    Also, Baltimore inside linebacker Ray Lewis is 36, in his 16th season. Safety Ed Reed is 33, in his 10th campaign. Patriots tight end Rob Gronkowski, 22, stands 6-6, 265. You do the math.

    The Ravens definitely are deserving of a berth in this AFC Championship Game. They have the talent, experience and coaching necessary to stymie the Patriots and reach the Super Bowl.

    But as bullies, they still have a lot to prove. They?ve been smacking around 98-pound weaklings this season -- relatively speaking, of course -- with little concern for taking one on the chin in return. If they don?t produce the kind of pass rush on Brady that the Giants generated against the Packers, for instance, they?ll join the Packers on hiatus.

    You never really know how tough a bully is until he gets bullied himself.
